By accessing or using this website you accept these Terms and Conditions. If you do not accept them, please do not use the site.

These terms cover this website only. If we do work for you, that engagement is governed by the statement of work, master services agreement or other contract we sign. Where this page and a signed agreement disagree, the signed agreement prevails.

Changes

We may revise these terms at any time. The date at the top of this page is the date of the last revision, and continuing to use the site after a change means you accept the revised terms. We may also change, suspend or withdraw any part of the site, including taking down or revising published articles, without notice.

Availability of the website

We make reasonable efforts to keep the site available, but we do not guarantee uninterrupted access. Access may be suspended for maintenance, security or reasons beyond our control. We are not liable if the site is unavailable at any time or for any period.

Your interaction with the website

You may read, quote and share our content with attribution and a link. You may not:

• copy or republish substantial parts of the site as your own;
• scrape it at a rate that degrades it for others, or in a way that disregards robots.txt;

All content on this site — text, images, diagrams, data, code, commercial names, trademarks and logos — is owned by us or used with permission, and is protected by copyright, trademark and other laws. Nothing on this site transfers any right in it to you beyond the limited permission to read and quote it described above.

Third-party trademarks named here — Microsoft, Power BI, Snowflake, Databricks, AWS, Google Cloud, Tableau and others — belong to their respective owners. We name them to describe work we do with those products. We are not affiliated with them except where we state a partnership explicitly.

Links to third-party resources

This site links to external websites and loads third-party services such as analytics, chat, maps and embedded video. We check a link when we add it; we do not control what the linked site publishes afterwards, and we are not responsible for its content, its availability or its handling of your data. Their own terms apply when you use them. Tell us at askus@algoscale.com if a link here leads somewhere it should not.

Information collection

Processing of personal data in connection with your use of this website is governed by our Privacy Policy and our Cookie Notice.

If you send us an enquiry, a comment or a file, you confirm you have the right to send it, and you permit us to use it to respond to you and to run our business. Do not send confidential information through a web form or chat; use a signed agreement and a channel we agree with you.

Disclaimer

We publish articles, case studies, benchmarks and pricing comparisons as general information, researched carefully and dated. Even so:

• third-party pricing and product capabilities change without notice, and a figure correct on its publication date may not be correct today;

The foregoing does not affect any liability that cannot be excluded or limited under applicable law. Where liability cannot lawfully be excluded — including liability for death or personal injury caused by our negligence, and for fraud or fraudulent misrepresentation — our total liability is limited to the smallest amount permitted by that law.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless Algoscale, its affiliates, and their directors, officers, employees and agents from and against any claim, demand, loss, liability, cost or expense (including reasonable legal fees) arising out of or connected with your breach of these terms, your misuse of this website, or your violation of any law or of the rights of a third party.

We will notify you of any such claim without undue delay, and you may not settle it in a way that imposes an obligation or an admission on us without our prior written consent.

Governing law

These terms, and any dispute or claim arising out of or in connection with them or with your use of this website (including non-contractual disputes or claims), are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You and we submit to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.

Waiver and severability

If we do not exercise a right under these terms, or do not enforce a provision, that is not a waiver of the right or the provision. If any provision is held invalid or unenforceable, it is to be limited or removed to the minimum extent necessary, and the remaining provisions continue in full effect.

Entire agreement

These terms, together with our Privacy Policy and Cookie Notice, are the entire agreement between you and us concerning your use of this website, and supersede any earlier understanding about it. They do not affect any separate signed agreement between us.
